Recites declaration 1 Dec 1821 that Sir R L Dundas should stand posessed of the £5000 bequeathed to Mary Viscountess Milton by their father to her use. This sum was invested in the purchase of new 4% bank annuities. These annuities were sold to accomodate Earl Fitzwilliam and the sum was secured to Dundas by bond. Mary died 1 Nov 1830 without exercising her power of appointment over the trust and her husband, Earl Fitzwilliam, claimed to have become entitled to the fund. Sir R L Dundas 23 Nov 1844 and Thomas Earl of Zetland was his only executor. In return for the sale of the annuities and cancellation of the bond Lord Fitzwilliam releases all claim on Lord Zetland in respect of the above trust fund and warrants him against all actions in respect of it |
