Recites lease and release of even date whcih recites that Sir Thomas Dundas is entitled to the equity of redemption of property subject to mortgage of £6200 (the remainder of a principal sum of £49000) and mortgage of £8000 secured by bond and deed of 28 May and 21 may and conveys to Lord Fitzwilliam and Charles Dundas property in Sligo and Ross Common in Ireland on trust to sell in order to discharge mortgages.
And recites that Sir Thomas Dundas has occassion to borrow £36000 and has applied to Lawrence Dundas to join with him in a mortgage of the Yorkshire estates. Lawrence has agreed on condition that the money remaining from the sale of the Irish estate after the discharge of the mortgages of £6200 and £8000 should be applied towards discharging this additional mortgage
And recites mortgage of 2 and 3 Marrch
Now Sir Thomas Dundas directs that Lord Fitzwilliam and Charles Dundas shall stand seized of the surplus of money arising from the slae of the Irish estate after the discharge of the mortgages towards the discharging of the principal of £36000
