Recites marriage articles of Mary Udney and Sir William Augustus Cunynghame 17 Jun 1785 by which £12000 was to be paid by Robert Udney of whcih £2000 was to be paid to Cunynghame to be held for his life, remainder to children and £10000 to Mary for her life, remainder to children
And recites bond of Robert Udney to Sir Thomas Dundas an Edward Vaux for £10000, 16 May 1787 for payment of £5000 and a deed of same date by whcih Dundas and Vaux agreed to invest the £5000 in trust for Mary
And recites will of Robert Udney 1 Jun 1801 directing executors to pay Dundas and Sir William Forbes (trustees of the marriage settlement) £5000 in trust for Mary Udney died 8 Jan 18102
And recites that £3500 of the £10000 settled in 1785 was charged on property at Teddington, Middlesex and £6500 was invested in purchase of £9904 15s 6d, 3% consolidated bank annuities iin the name of Thomas Lord Dundas. Thomas Lord Dundas survived Edward Vaux and invested £5000 secured by bond in the purchase of £2280 10s bank stock in his name. Of the £5000 bequeathed by will £1825 16s has been paid to Lord Dundas and invested in theourchase of £759 6s 2d bak stock. These sums have been increased to £3799 15s 2d by interest and bonus, £3500 (part of the £10000 was invested on 2 Dec 1825 in the purchase of £1608 5s 5d bank stock in the name of Lawrence Dundas whcih together with the £3799 15s 2d previously standing in his fathers name amounted to £5408 0s 7d. Sir W A Cunynghame and wife Mary had 5 children, William Augustus (died 20 Sep 1827 intestate), George Augustus Frederick, Frederick Alexander, James Stewart (died under 21, May 1813) and Mary. Frederick Alexander declared his acceptance of the sum of £4000 as a marriage portion in satisfaction of his share of the above sums 11 Aug 1823. Sir William Augustus bequeathed by will 18 Dec 1827 the residue of his personal estate to George Augustus Frederick and died 17 Jan 1828. Will proved PCC 26 Feb 1828
And recites assignment of portions under above settlements by George Augustus Frederick Cunynghame to Henry Dawkis 1 Mar 1830, to secure £4000 and further charge of £2500 1 Jul 1834 with assignment of Frederick Alexanders portion
And recites assignment of portion 21 Apr 1837 by Frederick Alexander to William Simmons to secure £450. Frederick Alexander shortly afterwards left England to live in York in Upper Canada and assigned his iinterests in the above sums to George Augustus Frederick Cunynghame, there remained due to William Simmons £511 17s 7d for principal and interest and George Alexander Frederick by assignment further charges the portions with £688 2s 5d, 21 Apr 1837. These sums were subsequently repaid by George Augustus Frederick Cunynghame
And recites reassignment on repayment of above sums, by Henry Dawkins and William Simmons to George Augustus Frederick Cunyngham 22 Jun 1843
And recites the assigment of portion by George Augustus Frederick Cunyghame 23 Jun 1843 to Laurye Spottiswoode, Sutherland and Webster for £26000
And recites Dame Mary Cunynghame bequeathed her personal estate to George Augustus Frederick Cunynghame by will 11 May 1842, she died 19 Jan 1846 and the will was proved in PCC
And recites George Augustus Frederick was therefore entitled to 3/4ths parts of the above settled sums and his sister Mary to 1/4th part
And recites 2/4ths parts of the £9904 15s 6d, 3% consolidated bank annuities and of the sum of £1608 5s 5d bank stock and the sums of £2280 10s, £759 19s bank stock was sold by his trustee Lord Zetland for £9596 10s 10d, which was paid towards the repayment of the mortgage of £26000
And recites by direction of Mary Cunynghame 1/4 part of the above sums was paid to her trustees Rear Admiral John Sykes and David Thomas Cunynghame

Now the remaining 4th part of the sums of £9904 15s 6d, 3% consolidated bank annuities and £1608 5s 5d bank stock have been sold for £3240 9s 10d and party 1 grant a release in repsect of the other sums recited above
