A piece of ground at Croft, bounded on the east by the river Tees, on the west by the road from Darlington to Northallerton, on the south by premises occ. by Mistress Isabella Newby and on the north by Croft Bridge measuring E-W 211 feet at the south end and 198 feet at the north end, and from N-S 293 feet, lately occ by Ralph Hodgson as tenant
Covenant that (2) within 18 months will build a dwelling house of 'good and proper bricks, timber and other durable and proper building materials', the land in front of the building to be laid out ina pleasure or garden ground 'in a neat and tasteful manner'
(2) to keep such building in good repair, leaving specified fixtures at the determination of the lease and is to make and maintain a fence or wall to preserve the east side of the premises from damage by the river Tees The wall fronting the road leading from Northallerton on the west of the premises is to be 3' 9" high; but (2) may fix a 'neat iron pailing of 3' 6" high to protect the premises (2) may build hot houses, greenhouses and a fruit wall around the north and east parts of the premises, to commence at or near the old stable on the north end of the said piece of ground, but may not erect any fence or building which interferes with the view from the inn at Croft now occ by John Robinson as tenant to Wm Chaytor (2) is not to build more than one dwelling house, and is not to erect any other bulding or make any alterations on the north or west front of the building (2) is to paint all the outside wood and iron work of the dwelling house, twice in every seven years, and all the wood and stucco work on the inside of the dwelling house is to be painted twice over, once every seven years (2) is not to practise the trades of butcher, slaughterman, tallow chandler, soap maker, tobacco pipe maker, smith, common brewer, coppersmith, working brazier, pewterer, tin plate worker, cooper, beater of flax, innkeeper, tavern keeper, or coffee house keeper, or any retail trade, or allow any public sale or auction without the consent of (1) (2) to insure the property from fire at £500
Recites: will of William Chaytor of Spennithorne esq, dated 4 April 1809 devising the manor of Croft and all his lands and tenements there to Timothy Hutton of Clifton Castle, esq, to hold to such uses as William Chaytor, eldest son of the testator might direct, and otherwise to the use of Wm for life, with remainder to Hutton in trust for the life of Wm, so that his wife should not be entitled to dower, with remainders as therein specified Wm Chaytor senior died 20 May 1819 and Wm Chaytor jnr has not exercised the power of appointment
