Codicil:
Wife and he have consulted and if they have no child, they wish to appoint a member of Countess Talbot’s family to be heir, so that two estates shall not join they adopt Lady Talbot’s second son as heir
Appoints settled estate to the Most Honourable Henry de a Poer Beresford, Marquess of Waterlord and John Topham of Middleham, gentleman, to the use of Right Honourable Sarah, Countess of Tyrconnel for life, then as she shall appoint, then to the use of the Honourable Walter Cecil Talbot, 2nd son of Right Honourable Henry John Chetwynd, Earl Talbot for life; remainder to sons in tail male, then to successive sons of Lord Talbot in tail mate, then younger sons of Lord Waterford; trustees to preserve the contingent remainders - the Honourble and Reverend William Scott of Maiden Newton, Dorset and the Reverend Anthony Cumby of Button on Swale, clerks
Clause for heir to take name and arms of Carpenter
Furniture, live and dead stock, personal estate (as in will) to Lord Waterford and Topham in trust for Countess or child
Power to appoint new trustees
If Lady Tyrconnel dies before him, Lord Waterford and Topham become executors
