Sool had previously been convicted of felony at the Quarter Sessions for the borough of Kingston upon Hull held at the town hall of the borough of Kingston upon Hull on 4 April 1839

With certificate of conviction at the Quarter Sessions for the borough of Kingston upon Hull held at Kingston upon Hull on 4 April 1839 of Herbert Sool late of the parish of Holy Trinity labourer for stealing five gold coins called sovereigns value £5, ten gold coins called half sovereigns value £5, 20 silver coins called crowns value £5, 40 silver coins called half-crowns value £5 100 silver coins called shillings value £5 and 200 silver coins called sixpences value £5, the property of John Batty, at the parish of Holy Trinity on 23 March 1839. Sool was sentenced to hard labour at the gaol of the borough of Kingston upon Hull for three calendar months. Certificate dated 6 October 1840
