David Moore was in gaol as an insolvent debtor and had petitioned for his release from confinement. Merryweather and Robert Moore, intending to defraud David Moore's creditors, executed an indenture of assignment on 1 November 1825 between David Moore of Appleton Wiske weaver devisee and sole executor of Thomas Moore of Appleton Wiske yeoman deceased and Robert Moore of Appleton Wiske weaver of the first part, William Moss of Northallerton yeoman of the second part and William Merryweather of Yarm innkeeper of the third part, to convey property in Appleton Wiske, so allowing David Moore to omit the property from his schedule of assets when he drew up his petition. The deeds to the property had been used to secure £105 7s which David Moore owed to William Driver
