He would like the cause to be set down for trial at the next Session if the parties have not reached agreement beforehand. To enable them to come to an agreement, Wharton did not bind over the complainant to prosecute but took the recognizance of the party complained against. Wharton suspects that he may have acted irregularly in the matter
