- undated complaint of Daniel Seaton that, following the Act of Parliament of 1789, the Trustees of the road have caused part of the ancient highway between Helmsley and New Malton to be fenced off or stopped-up, so making travellers pass for 112 yards on part of the road managed by the Trustees, and so making them liable to pay the toll as they pass through the turnpike bar at Oswaldkirk Bank Top. A jury was impanelled to look into the complaint, and their verdict was that the highway should be free for travellers
- undated draft order of the Court to receive the complaint and respite the hearing until the next Sessions. The sheriff is to impanel a jury to enquire into the complaint
- copy order made at Quarter Sessions relating to Daniel Seaton's complaint. At the Quarter Sessions held at Northallerton on 13 April 1790, the complaint made by Daniel Seaton at the last Quarter Sessions held at New Malton against the Trustees of the turnpike road leading from the city of York to the top of Oswaldkirk Bank, was heard. It was agreed by counsel and attorneys for both parties that the entry in the court record of the Sessions held at New Malton on 12 January 1790 should be amended to include the manner of choosing jurors. Endorsed with a certificate naming the three men nominated as jurors by each side to view the road, namely William Laybourn the younger, George Fox and Christopher Bowran, gentlemen, nominated by Daniel Seaton's agent, and George Stephenson, Thomas Wilks and Godfrey Hirst gentlemen, nominated by the agent of the Trustees. On 14 July 1790, they viewed the road, in the presence of Anthony Thorpe gentleman under-sheriff, and by Ralph Burton of Salton land surveyor, appointed by Seaton and George Britton of Hovingham yeoman appointed by the Trustees |
