Summary of Case: At the outbreak of war all the staff joined the army. They employed five staff but with the exception of the Mr Witts they have also now joined the army only leaving the two garage owners, one of whom is unfit medically and the other discharged due to war wounds. The garage carries out repairs to army and medical vehicles. The local tribunal refused the appeal on the grounds that the two owners could carry out repairs being qualified mechanics. They appealed against this.
