Summary of case: Whelan’s employer needed him as he had already lost two employees to HM forces. The local tribunal refused as Whelan, and the business was not indispensable and no serious hardship would ensue. In his appeal to the North Riding Appeal Tribunal, Whelan referred to his widowed mother, his blind sister and younger brother and sister still at home, all were financially dependent on him. Also, he had spent around 40 pounds on a salmon fishing boat etc; if he could be kept back until about Aug 1916 this would give him some time to get some return on his outlay.
