Description | North Riding appeal tribunal number: 5728 Appeal against conscription of: David R Ellerby Age: 24 Address: 7 Waverley Street, York Occupation: Chemist Local tribunal: York City Council Central tribunal: No Military Service Act 1916 or Attested: Military Service Act Grounds for appeal: d) serious hardship Medical grade: 1 Appellant: D R Ellerby Summary of case: The appellant had been granted exemption from military service on 8 Nov 1917 due to his domestic circumstances ill wife. Subsequently he received a further exemption certificate on 24 Apr 1918 to 6 Feb 1918 on the grounds of serious hardship. Ellerby and a representative of Raimes & Co, his employer, appeared before the local tribunal on 9 July 1918 to state his case on the grounds of serious hardship if he went to war, as his wife was suffering from Rheumatoid Arthritis and needed his help to carry out everyday tasks. The local tribunal recognised that the appellant's wife's health is bad, but it did not seem to be such as to call for her husband's retention. Ellerbys wife's family, mother and sister lived in York and could be called upon to help. In view of the fact that the man is only 24 years of age and a grade 1 man they thought the domestic claim was not strong enough to justify exemption. The Appeal was dismissed on 23 Aug 1918 with exemption to 23 Nov 1918 to give time to make arrangements. Final. Yet another appeal was made on 11 Sept 1918 as the appellant's wife's health had deteriorated significantly and she was now bedbound with Rheumatoid Arthritis.
