Summary of case: The local tribunal granted conditional exemption for three months subject to remaining in present occupation. The national service representative asked for a medical examination and Spelman was classed a Grade 1 man. In light of this the local tribunal cancelled his exemption stating that ‘he should join the army.’ Spelman appealed this decision: ‘I am a coal dealer carrying on a business established by me 19 years ago. Al my capital is in the business and I have three horses and three Rolleys. I have two spare time men and a boy and a cripple to assist me. ….My wife is in delicate health, she was in bed 9 months last year.’
