The National Service Representative appealed, saying that there were plenty of dentists in the Middlesbrough area. On 2nd May Walker wrote to the North Riding Appeal Tribunal for leave to appeal to the Central Tribunal. He presented details of the other dentists in the area and said he intended to bring evidence that the National Service Representative 'knowingly or unknowingly made statements with regard to the local supply of dentists which were utterly false and misleading' which he could now refute. In the appeal papers he gave details of the local provision and also quoted similar cases circulated to tribunals for guidance. Walker was a one-man practice and his secondary claim for exemption was that his whole capital was invested in the business which would collapse in his absence. He had a pregnant wife and dependant maiden aunt. His application to appeal to the central tribunal heard on 28 May 1918 and refused.
