Summary of case: The employer states that this man is the only make assistant in the Grocery Division. He was transferred (as a Class CIII man) from the general office to substitute a man already in the fighting line. As Mr Libly substituted a fit man as per a previous recommendation of the Local Tribunal the fact of his being called up is due to some misunderstanding. The local tribunal notes that there is another man – Branch Manager – of Military age in the department and consider that this together with fact that there is a good supply of female labour capable of doing the work, no hardship is involved in the withdrawal of Mr Libly.
