Summary of Case: Employed as an assistant to a dispensing chemist and optician whose business is to dispense prescriptions under the National Insurance Act. His employer commented that ‘this dispensing we undertook to do on the understanding that we should not be deprived of our assistants’. In addition to this his employer undertook voluntary work dispensing for the Red Cross and Rutson Hospital. He dispensed 750 prescriptions every month and required a competent assistant to help him. Employer was unable to find a female or ‘secure a chemist over military age with the necessary experience to dispense’. A note attached to the case papers states that he was not a qualified chemist.
