Summary of case: The local tribunal had ordered Marshall to appear before the Army medical board again after his discharge from the Army – date unknown. He was classified as B1 again. He maintains that his ill-health, hammer toes and diphtheria, resulted in him having to ‘just slack about the camps’ which led to his discharge. He pointed out that his domestic circumstances had become more severe as he was his mother's sole support, his sister having died, and three brothers had been called up, one already killed. His mother is 68 and could not read or write. The local tribunal heard from his trade union representative, as he was now employed at Rowntree. However, they felt that they could not ignore the medical classification fixed after such a sound examination.
