Summary of case: Appeal to local tribunal stated “(a) I am a small farmer …My father who is 71 years of age and is crippled and an invalid – I also have the only blacksmith shop in the place and so am of importance to the farmers round about. … I am the only support of my father aged 71 years a cripple and an invalid and of my mother aged 71 years…. I do more farming than blacksmithing”. The Local appeal tribunal reasons for their decision: “The farm is in father’s name and consists of 11 acres of grass land… father 71 can only milk, nothing further. Applicant and a married brother at home for past 3 months but now the married brother has taken a blacksmiths shop at Cowton, belonging to his father-in-law. A younger brother is working at Richmond camp. The Applicant is stated to have had time for [pig jobbing] in the past and having regard to call the circumstances of the case the tribunal were not satisfied as to the man’s alleged certified occupations or as to special hardship and refused the application”. Subsequent to the decision of the North Riding appeal tribunal, on 31 Oct 1917 letter from clerk of local tribunal states “Grainger came before the appeal tribunal on the 13th April 1916, the appeal was allowed, and one day’s exemption granted which, as the law then stood, allowed him two months’ exemption. Subsequently he was called up for medical examination, and rejected, whereupon he came under sub-sec. 5 of Schedule 1 of the Military Service Act, and was therefore exempted from the provisions of the Act, and did not require a Certificate of Exemption which had been granted to him by the appeal tribunal”.
