He appealed on 28 July 1917 to the local tribunal who refused the appeal. Harper then appealed to the North Riding Appeal Tribunal. However, the solicitor confused the issue at the hearing stating that another employee, Metcalfe, of Messrs Balliser Bros had been exempt on personal grounds, which was incorrect. The tribunal had granted exemption purely on business grounds, as he was indispensable. The employers could release Harper and therefore he could be called up.
