Summary of case: Ernest and A G Lodge appealed on the grounds that Ernest Wright Lodge was “Indispensable in successful carrying on of farm in occupation of my brother A. G Lodge, in whose employ I am. Beyond a young boy I am the only hired person on the farm, and it is impossible to obtain labour and thus fill my place. The farm is strong clay land and for this reason requires additional labour in the successful working. For the past 10 years I have suffered from a physical infirmity which during [our] main season of the year renders me practically unfit for work and as evidence of this I provide a certificate to this respect from my medical attendant, as the brother and employer of E. W. Lodge confirm the above statement”.
