Summary of case: ‘The appellant (47 Managing Director and Secy., W Rapp & Sons Ltd) is nominated as Assistant Adjutant of proposed new Volunteer Battalion for Cleveland and would devote himself to this military work if Horsely given conditional exemption. Horsely is man of poor physical stamina and is classed C1. He is volunteer in military training and available for coast defence and at same time is maintaining himself and family and helping business of nation. Horsley is employed on work for the military, Ministry of Munitions Cleveland Miners Assoc., Skinningrove Iron Co and other ironstone and coal mines and general public work. Horsley is essential to carrying on printing business as he is the only able-bodied man left capable of heavy work, though incapable of exposure and hardship.’
