The employers appealed to the local tribunal stating that their managing director was a member of a War Office committee, and they supplied all army establishments within 12 miles of York. They had only two left of twelve drivers. The appeal was refused, but Duston was not to be called up until 17 May 1917. In their reasons for this decision, the local tribunal stated that when a substitute driver was offered to the employers the managing director refused even to see him, saying that he would not take the onus of sending a man into the army.
