The case was referred to the Central Tribunal who wrote back stating: ‘decided that the points referred to them appear to have no substance in it. Tribunals have no jurisdiction to decide whether a man comes within the exceptions mentioned in the First Schedule of the Military Service Act 1916….The Central Tribunal decided to remit the case to the Appeal Tribunal [North Riding] to be dealt with on its merits.’.
