He wished to apply to the Pelham Committee but the Redcar Tribunal had no information about this. He made a second appeal, again asking to go before the Pelham Committee for suitable non-combatant work to be assigned, but the local and county appeal tribunals refused to hear this second appeal. On 16 May 1916 he is handed over to the military and taken to Richmond Castle.
