Summary of case: Frederick Colley runs a coal business; one man has joined the army leaving only Charles to help, without him he could not carry on the business. Charles Colley has previously been rejected due to suffering from “St Vitus Dance” and has spent nine weeks in a sanatorium for Diphtheria. The local tribunal found he was not in certified occupation and his health would be no worse in the army than in civilian life. They also were not satisfied than a replacement could not be found.
