The military representative appealed on the grounds that Bennison had been passed for general service and it was in the national interest that the exemption is subject to a satisfactory substitute being found. The local tribunal refused this and the Military Representative then appealed against their decision. The appeal was allowed and Bennison's exemption was to be varied. Bennison was to have conditional exemption until an efficient substitute was found to be approved by the Board of Agriculture. However he was not to be called up till 15 May 1917.
