The appellant had also been before the medical board and was not passed for general service. He was however, in the Volunteer Regiment and giving 'all possible time' to drill the night guard duties. The appellant's father who is now 70 is medically incapable being 'nervously prostrate' as a result of gall stones causing biliary colic and 'nerves'. Various relatives have given financial assistance to the business which is now owed. In addition there is no-one who could carry on the business without the appellant. The applicant himself suffered muscular Rheumatism and Neuritis accompanied by anaemia. He also has a cough caused by deficient air entry to his left lung. 29 Nov 1916 the local tribunal granted absolute exemption on the grounds of “exceptional business and financial responsibilities”. The decision was given by an enlarged tribunal and was unanimous that the appellant should be exempt. The military representative however, took objection to the decision the following day, pointing out that the local tribunal did not have the power to grant absolute exemption and should have given him conditional exemption to which the military representative would not have objected. He went before the North Riding Appeal Tribunal to have this altered, but instead of being conditional exemption they gave him temporary exemption.
