Summary of Case: John Kellett appeals on 4 Dec 1916 after the appointed date because James Smith Black refused the company's original offer that they would appeal on business grounds. James Smith Black had already appealed on conscientious grounds and this had been upheld by the local tribunal but the Central Tribunal dismissed it. The local tribunal dismissed the appeal from John Kellett as ‘the decision of the Central Tribunal was given on 15 Sep 1916 ...it is unreasonable to have withheld their application until now.’ The North Riding Appeal Tribunal ‘Adjourned 25 Dec 1916 for recommendation of National Health Assurance Commission.’ Reheard by North Riding Appeal Tribunal 20 Jan 1917: ‘The applicant admitting that there had been no decision of local tribunal consequently the North riding Appeal Tribunal considered that they had no jurisdiction, in addition they considered the appeal should be dismissed on merits having heard all the facts.’ Case papers contain correspondence between tribunals and newspaper cuttings, Whitby Gazette Oct 1916 and Jan 1917
