Summary of case: Newiss suffers ill health and cannot manage without Ashby as he is unable to lift heavy loads. Without him the employer would suffer serious hardship. The local tribunal decided that there would be some hardship caused by the man being called up but not of an exceptional nature. Substitution by women could be considered as the heavy nature of the work could be surmounted by the use of trucks, weight lifting appliances or dividing the sacks into smaller manageable quantities for women to lift. 'Two women can (at little or no further expense) be engaged, to take one man's place. Since their decision the [local] tribunal have received a book issued by the War Office entitled 'Women's War Work which confirmed them in their decision.Â’
