The tribunal agreed and granted conditional exemption as long as he remained in his current employment and provided he joined the Volunteer Training Corps. The military representative suggested that the exemption should be limited to six months to allow his father to find other workers. The North Riding Appeal Tribunal allowed the appeal. There was then a further appeal by his father on the basis that all attempts to find alternative employees had failed. The North Riding Appeal Tribunal declined to entertain a further application.
