Summary of case: Smithson is indispensable for the running and upkeep of the engine and machinery of a printing business which employs no other man of military age. The North Riding Appeal tribunal dismissed this appeal. The firm of Charles W Smithson then attempted to appeal to the Central Tribunal: The Appeal Tribunal places the firm in an impossible position as they would be left with a staff of two boys, one 15 and other 16 years old. Managing Director fully occupied with clerical work etc. One skilled man is essential to run the engine and machines. The work is specialized and includes large standing order for Wensleydale Pure Milk Society and Poultry and Egg Producers all over the Country. Casual help from other printer in town as suggested by Appeals Tribunal would be but of little use to us. The North Riding Appeal Tribunal refused leave to appeal to the Central Tribunal and the original decision stands. [See also NRCC/CL 9/1/755]
