Summary of case: At the local tribunal, Lynas's employers said their ironstone was used for munitions work and their output was already below requirements. So it was more useful to the national interests if he remained. This was dismissed. At the North Riding Appeal Tribunal his employers made the same point, adding that in their opinion ‘he is too undersized to ever make a good and efficient soldier’. The local tribunal did not comment on this later point but said that, as Lynas was only a driver and not a skilled miner he was not in a certified occupation. Lynas' employers then tried to appeal to the Central Tribunal. The North Riding Appeal Tribunal, after refused leave to appeal to the Central Tribunal.
