Appellant: Thomas Bateman, Director of Redcar, Coatham, Marske and Redcar Gas Company.
Summary of case: He is Chief Clerk and cashier acting as Secretary to the above company. They run a gas works which manufactures gas and extracts toluol. Due to the death of the Secretary and the enlistment of all the clerks he is the only one conversant with the Secretarial and Commercial side of the business. The local tribunal gave him a temporary exemption for one month conditional on him remaining in his present occupation. Evidence from local tribunal to North Riding Appeal Tribunal states that the company have appointed a new manager and secretary who is 30 years of age and unmarried. Mr Herris is acting as manager and secretary until new man takes up duties. They sate one of them should go. The Company gave detailed evidence to the North Riding Appeal Tribunal on their business supplying gas, including to the railways, coke, producing Toluol [toluene] at the express wish of the Government etc. They stated that over 40% of the men from the works have joined the army and all four clerks leaving only Mr Herris who they regard as indispensable and doing work of national interest. However Mr Herris was badged on 23 August 1916 before the appeal hearing and hence their solicitors did not attend.
