Summary of case: David appealed on the fact that he was a smallholder and an assistant overseer collecting rates for the local parish. Additionally he thatches and stacks for other farmers. He has had two hernia operations and is not physically strong being still 'under the doctor'. He has a very delicate wife an infant child dependent upon him. Joining up would mean losing his holding and overseers job. The local tribunal had stated that there were two brothers in this family and 'it was thought that one of the two brothers should serve his country and the tribunal dismissed this application on the understanding that if Martin (who is the younger and more suitable man, the applicant having been passed for garrison duty abroad only) joins the colours now he would be accepted in the place of the applicant.'
