Summary of case: Appellant is joint tenant with brother, who is 57 years old. They farm two farms Moorland Farms, called Merebeck and Lopes in the township of Cotherstone. Sheep stints on Clotherstone Moor, and Lopes 200 acres with 150 sheep stints on moor. With about 130 of meadow land on both farms. He also as a total of 430 stock including cattle, incl. milk cows, ewes with lambs, young sheep and two horses. They have no hired help. The Local tribunal state that the brothers applied for the tenancy of the second farm of Lopes, whilst previous exemption existed from local tribunal. When appellant made first appeal application, there was no mention of the negotiations for the second farm.
